'I stopped PM from ordering Yong's arrest'

Sapp information chief Chong Pit Fah described this as a "a shocking revelation" that he (Raymond Tan) can influence the prime minister to stop ACA action.

"This is an admission by a BN deputy chief minister that the prime minister can interfere with ACA work," Chong said in a statement issued yesterday.

He also wanted to know if the same influence could be used on other persons such as serving ministers, or similarly abused. More...

  1. If our country still have a so called JUSTICE system, Mr. Tan should be under investigation by ACA. This guy bring SHAME to Sabah Chinese. This guy is simply not fit to be the DCM for Sabah especially the chinese.

  3. This statement by Raymond Tan proves a few things, namely...

    (1) BN Government practice selective prosecution;
    (2) THE PM can interfere in the ACA's investigation;
    (3) AAB can be influenced by Raymond Tan (wow... powerful lah kau Raymond..);
    (4) If you are aligned to the BN Government.... you can mess with the whole system and not get persecuted... but if you are on the other side of the fence... you can be sure of a "very fast action" taken against you; and last but not least...
    (5) This BN government is simply NOT a fair government... SO... bye bye gaman lah kau BN.

  5. 1. Sebelum ini Datuk Raymond dibimbing oleh YTL sehingga berada dikedudukan yang selesa dalam karier politik dan Kerajaan.
    2. Sejak meninggalkan SAPP, Datuk Raymond sering melakukan kesilapan kerana kehilangan kompas penunjuk arah.
    3. Raymond seola-ola telah lupa atau pura-pura tidak tahu tahap kekuatan dan keutuhan SAPP. Memancing ahli-ahli SAPP dengan menggunakan wang atau projek tidak akan dapat melenyapkan SAPP dalam arena politik di Sabah/ Malaysia.
    4. Kenyataan Raymond bahawa dia berjaya mempengaruhi PM agar tidak menangkap/menahan YTL merupakan satu pendedahan yang amat menarik.
    5. Kita tunggu dan lihat apakah respon dari PM, ACA dan Raymond. Jangan-jangan tekaan "urang" betul kononnya wartawan salah quote!

  6. Given Malaysia's overall corruption, it is not surprising that ACA could be influenced. I don't think anybody is surprised that it is the PM who determines who should be investigated and who should not. The ACA is just another weapon in the UMNO-BN arsenal for controlling and suppressing opposition.

    But it is time for this shameful state to go. Malaysia must be based on equality and justice. Those who are corrupt must be punished and those who are innocent must be protected. Government must not deny basic rights to some segment of the people and force them to pay bribes to get what they deserve under UN human rights.

  7. China successfully launched Shenzhou-7.

    China has successfully launched Shenzhou-7 which is a spaceship carrying 3 astronauts which will go into orbits around the earth. It will conduct China's first space walk for the first time. China will be the 3rd country to conduct spacewalk. The other two countries that have conducted spacewalk are America and Russia. Not even Japan, Germany, UK, or France have succeeded to launch manned spaceships let alone conduct spacewalk. This is obviously a great technological achievement. The most significant thing is that China has developed its space program independently without transfer of technologies from foreign countries. This is a very important evidence that China can independently advance its own high technologies. Other important projects in China's space program are moon landing, geoposition satellites, etc.

    This underscores the rapid advancement of China's economy and technologies. Obviously China's economic and technological advancement will have a great impact on SE Asia in general and Malaysia in particular. As China rises, it will be able to supply high tech products such as communications satellites and jumbo jets to its ASEAN trading partners. Since Chinese products will be cheaper while being of high quality, it will allow ASEAN countries to have higher standard of living by trading with China. China's expanding market will also provide a big market for the products of ASEAN countries in general and Malaysia in particular. This will allow Malaysian economy to expand to hire more workers at higher wages. Therefore, the rise of China is coming at a very good time for Malaysia and will benefit Malaysia's economic development for decades to come. China's rise is also coming at a right time because the economy of America, Japan, and EU are all reaching their peak and could not expand much more which means Malaysia cannot rely on these countries to import more of Malaysia's exports.

    While the talk now is about China's contaminated food which is obviously a matter of great concern to the Malaysian people. But Malaysians should also maintain a bigger picture and see things in larger perspective about China's overall rise and its benefits to Malaysia in terms of expanded trade in many sectors for decades to co

    Terima kasih kerana telah singgah utk jenguk-jenguk blog KR.
    Lagipun KR tak paksa mana-mana visitor meninggalkan komen kat blog KR umpama lagu "apa guna singgah kalau tak masuk".
    KR hormat dengan komen Katak Berlari walaupun hakikatnya rata-rata rakyat Malaysia dah tahu apa kah sebenarnya tujuan Datuk Raymond untuk terus kekal bersama BN... Itu tidak salah sebab kalau KR dalam kedudukan macam Datuk Raymond pasti KR akan terus kekal bersama BN!!!
    Mengikut cerita politik di kedai kopi, Datuk Raymond selaku Tim. Presiden, Tim Ketua Menteri dan Menteri penuh negeri hanya mampu mempengaruhi ahli SAPP dikawasan Tg.Papat???
    Persoalan dia ialah:
    1. DS Anwar (Tim Presiden) dulu kalau keluar UMNO membawa bersama bukan sahaja ahli UMNO dari Permatang Pauh, malah...
    2. ADUN Elopura yang juga mantan KP SAPP walaupun keluar SAPP tapi tidak sehaluan dengan Datuk Raymond...
    3. Kenapa Pen.S/U Agung SAPP mengeluarkan kenyataan mengatakan kenyataan akhbar bahawa 2000 org ahli SAPP yang keluar termasuk ahli HANTU...Betulkah???
    4. Ura-ura mengatakan agen Datuk Raymond sedang giat memancing ahli SAPP dari kawasan lain untuk mengkhianati SAPP seperti mana yang dilakukan oleh Raymond dengan menawarkan banyak tawaran dan janji. Kalau tak percaya sila layari Chedet.com!!! Raymond buat seiras macam DSAAB buat...

    Kalau nak kongsi semua sampai esok pun tak akan selesai. Jadi lebih baik Sdr Katak Berlari nasihatkan Datuk Raymond:
    a. untuk menumpukan perhatian kepada penubuhan parti beliau
    b. dapatkan ahli sendiri (kalau ahli SAPP yang mengkhianati SAPP kerana tawaran akan satu hari juga mengkhianat Raymond kerana tawaran)
    c. berkhidmatlah dengan penuh tanggungjawab dan kredibiliti kepada rakyat sebelum rakyat tidak perlukan khidmat beliau...

    Tuhan maha pengasih dan penyayang... mereka yang selalu berbuat baik akan diberkati dengan kesihatan dan dikurniakan dengan ramai anak, cucu & cicit... Mudah-mudahan hari tak jadi kemarau agar Sdr Katak Berlari tidak melarikan diri...

    Shad: It's not that simple. Because, under the Constitution, the Agong cannot dismiss the prime minister, the Parliament must dismiss the PM. And at the moment, the Dewan is not in session. If there is a vote of no confidence on the PM, it must be in the Dewan.

    In the above quote The Sun asked constitutional law expert Prof Dr Shad Saleem Faruqi about the procedure for Anwar Ibrahim to take over the government of Malaysia. I saw this article and took it for granted that Dr. Shad was correct in his statement that Anwar had no choice but to wait for Badawi to reconvene the parliament. But feeling that I should not automatically assume that Shad was right, I went to the Malaysian constitution to see what it actually says. Having read the relevant sections and articles of the constitution, I don’t think Shad was totally right. I don’t agree that Anwar had to simply sit and wait for Badawi to reconvene the parliament.

    Shad is correct to say that the King cannot dismiss the prime minister. It seems from Article 43(4) there isn’t any provision for anybody to dismiss the prime minister. It only says that “If the Prime Minister ceases to command the confidence of the majority of the members of the House of Representatives, …the Prime Minister shall tender the resignation of the Cabinet.” In other words, if the prime minister lost the confidence of the majority of the parliament then he must resign. But how does the PM know he has lost the confidence of the majority of the parliament? Shad claimed that such loss of confidence must be demonstrated through a vote of no confidence in the parliament. But there is no article in the constitution that says that specifically. Unless there is some other article in the constitution that I don’t know about, there is simply nothing anywhere that says demonstration of the PM’s loss of confidence must be done through a vote of no confidence in the parliament. If Anwar gathers up 112 or more of his supporting MP’s and present them to the public at a news conference, that would be ample demonstration that Badawi has lost the confidence of the majority of the parliament. Then Badawi would have no choice but to “tender the resignation of the Cabinet.”

    That is, Badawi and his entire cabinet must immediately resign as soon as Anwar can give a credible proof in any form that he has the support of 112 or more members of parliament. Such proof of majority support can, as I said above, be in the form of presenting the requisite number of MP’s in a news conference. Or it can be by presenting his supporting MP’s to the King. But one thing for sure, there is no provision in the constitution that I could find which says the demonstration of Badawi’s loss of majority support must be done in a vote of no confidence in the parliament.

    Of course, Badawi could also ask the King to dissolve the parliament and call for a new election. But the King can refuse to dissolve the parliament. Dissolving the parliament is entirely at the discretion of the King. Therefore, if the King refused to dissolve the parliament, Badawi must immediately tender his resignation and that of his entire cabinet. Once the King has received the resignation of Badawi and his entire cabinet and has refused to dissolve the parliament, he can immediately appoint Anwar as the next prime minister. Then Anwar can recommend his next cabinet to the King and have them appointed. Then the next government is formed.

    Shad tried to bolster his argument by citing the case of Stephen Kalong Ningkan vs Tun Abang Haji Openg & Tawi Sli 1967. But while the court said the governor cannot dismiss the chief minister and that the assembly must dismiss him by passing a vote of no confidence, yet there is nothing about the vote of no confidence must be passed in the assembly building. Or to put this another way, the question is not whether the King has the right to dismiss Badawi. We can all agree that constitutionally the King cannot dismiss Badawi. The question is whether it is constitutional to demonstrate that Badawi has lost his majority support if Anwar can present 112 or more of his supporters to the King or to the public through a news conference. If it is constitutional to demonstrate that Badawi has lost his majority support by Anwar’s presenting 112 or more of his supporters to the King or to the public through a news conference, then there is no need to go through a vote of no confidence in the parliament. In which case, there would be no need for Anwar to wait for Badawi to call the parliament into session.

    The Sun: So, Anwar cannot just march to the King and demand to be sworn in as the new PM as he has got the numbers? Is the King bound by the law to swear Anwar in as the PM?

    Shad: Yes, Anwar said they are going to the Istana. They are most welcome to the Istana; they can have nice tea there, I'm sure, but nothing more than that.

    Shad had misled The Sun and the Malaysian people in the above exchange. If Anwar could show the King that he has the number, then the King can summon Badawi and ask for his resignation citing his loss of the confidence of the majority of the parliament. Then Badawi must tender his resignation. And the King can then appoint Anwar as the next prime minister.

    Shad: A piece of paper with 112 names is not enough. Anyone can write their names. It has to be on the floor of the house.

    Of course, a piece of paper with 112 names in not enough. I can present a piece of paper with 112 names on it and claim to be eligible to be the next PM of Malaysia. But if Anwar can present more than 112 MP’s to the King in person, then that is much more than a piece of paper. The King should certainly ascertain that the MP’s do support Anwar by talking to them individually. But this can be done in less than an hour. The MP’s can line up and file past the King and say, “My name is such and such, I’m MP of such and such constituency, here is my IC and other proof of identity, and I support Anwar for PM.” And that would be ample evidence for the King to form an informed judgment that Anwar is “is likely to command the confidence of the majority of the members of that House.” (Article 43(2a)) And on that basis the King would have the constitutional power to appoint Anwar to be the new PM.

    Shad: Under Article 55 (1), the Agong on the advice of the PM can allow six months to elapse between one sitting and another. So he may just do that. It is untenable, democratically speaking, but PM Datuk Seri Abdullah Ahmad Badawi can rest for another six months.

    Again, Shad is less than totally truthful. The King can indeed allow six months to elapse before calling the parliament to convene. But the King also has the power to call the parliament into session at any time he chooses. The precise wording of Article 55(1) is as follows:

    Article 55(1) The Yang di-Pertuan Agong shall from time to time summon Parliament and shall not allow six months to elapse between the last sitting in one session and the date appointed for its first meeting in the next session.

    While the King can allow six months to elapse before summoning parliament into session, yet he can summon the parliament at any time he wished without consulting Badawi. And even if Badawi asked the King to postpone the parliament for 6 months, the King can constitutionally ignore him. So, Anwar certainly can petition the King to summon the parliament immediately into session. The King is under moral pressure to summon the parliament if Anwar can demonstrate to him that he has the support of 112 MP’s or more. And once the parliament is in session he can table the vote of no confidence and force Badawi to resign immediately. Shad tried to spin the constitution to create the illusion that Badawi can on his own power prevent the King from summoning the parliament. But the truth the King has the power to summon the parliament on his own authority whatever Badawi might wish to the contrary.

    The final analysis is that Shad had given an untruthful spin on the constitutional situation in Anwar’s attempt to topple Badawi. Shad tried to create the illusion that Anwar can do nothing but to wait for Badawi to convene the parliament. And that Badawi can postpone convening the parliament for as long as six months. The truth is that Anwar could petition the King to summon the parliament by demonstrating he has the support of 112 MP’s or more. Then the King would be under great moral pressure to summon the parliament. If the King still refused to summon the parliament, then Anwar could call a press conference and present his 112 or more supporters to the nation and demonstrate that he has the majority to form the next government. Then the King would be under even more moral pressure to ask for the resignation of Badawi and appoint Anwar as the next PM.

    My best advice to Anwar is to petition the King immediately to summon the parliament for the purpose of tabling the vote of no confidence. If the King refused to summon the parliament for any reason, then Anwar must present his supporters to the nation through a press conference. But I’m sure the King would summon the parliament if Anwar can show him that he has the majority.

    L (4) If the Prime Minister ceases to command the confidence of the majority of the members of the House of Representatives, then, unless at his request the Yang di-Pertuan Agong dissolves Parliament, the Prime Minister shall tender the resignation of the Cabinet.

  14. you ppl should not acuse YB Datuk Raymond Tan about he influenced PM to stop ACA to take action to arrest Yong Teck Lee. we should thanks him, or else yong teck lee already in lockup, and who will lead the party Sapp. as a chinese, he (YB Raymond) did the right thing at the right time. we shoud thankful to him and hopefully he will use his influence as A DCM to tell PM to release all those was arrested, after all we are all malaysian. thankyou.
