Fear Tactics to deter others from supporting

Yong criticised the Anti-Corruption Agency (ACA) for re-opening an old investigation related to allegations of corrupt practices when he was Sabah chief minister from 1996 to 1998.

"The action by the ACA on me is to deter others from taking the same stand as us. ACA is creating a situation of fear," he said. "Why investigate now when SAPP is moving a no-confidence motion."

Yong said the motive for his action was not greed as alleged but the failure of the federal government to ensure economic prosperity and security of his state on Borneo island.

The was an urgent need to resolve the growing problem of illegal migrants from the southern Philippines, he said.

Yong added that Sabah was entitled to 20 percent of oil royalties to bolster prosperity, instead of the five percent it currently receives.

Oil and gas is a state resource. Under the terms of the Federation Agreement, oil and gas, which is a state resource, belongs to the states, 100% (just like water, timber, tin, iron, gold, coal, etc.). However, in 1974, the federal government nationalised oil and gas and then forced all the 13 states to sign an agreement with Petronas -- whereby the newly created national oil company will become the owner of all the oil in gas and the states would just enjoy a 5% ‘commission’. Later, the states were forced to sign a supplementary agreement stating that the 5% ‘commission’ would be officially and legally called ‘royalty’.

The states really had no choice in the matter. This was not mutually agreed. What the federal government did was to pass a law in Parliament called the Petroleum Development Act 1974. By law, the states had to relinquish all rights over oil and gas and the federal government, through Petronas, took what belonged to the states ‘by force’. That not being enough, the federal government even violated the Petroleum Development Act plus also the agreement that the states were forced to sign with Petronas. In 2000, the federal government cancelled the 5% royalty due to Terengganu and handed it over to Umno to manage. And they also changed the name ‘royalty’ to ‘goodwill money’ -- which does not appear anywhere in the Petroleum Development Act or the agreement the states were forced to sign with Petronas.

Yes, the federal government has, time and time again, violated the terms of the Federation Agreement. And they violated it again in 1974 by nationalising a state resource -- oil and gas. And they violated it yet again in 2000 by cancelling the 5% royalty in spite of the 5% being morally wrong in the first place (but made legally right through an Act of Parliament). And now, after the 8 March 2008 general election, the federal government is up to its tricks again by denying the opposition-led states the funds it is legally obligated to give the states.

Under the 20-point Agreement, Sabah is not one of the states of Malaysia equivalent to Kedah, Kelantan, Penang, Perak or Selangor. Sabah is equivalent to Malaya.

  3. Dignity has its price and looking for dignity starts from somewhere, from someone, therefore you shouldn't be cowed neither should you submit. I can assure you in Peninsular Malaysia which outrightly rejected Barang Naik (BN), there is a lot of respect and solidarity for you and with you. Anyone SAPP member who betrays SAPP and its decision must understand that he/she no future and in the Peninsular, we will make sure that person bever leaves his village and comes to be part of the federal govt.

Dear Yong, people have had enough. Even the King got angry and refused to cooperate with BN unless BN accepted his conditions. They sacked the King's choice from UMNO but the King didn't give shit and insisted on his stand to refuse to cooperate with BN unless BN yields. He didn't respect them bcoz respect is a two way traffic. In the end, BN yielded and accepted his conditions. Already, the royalty is being returned to them and they are also demanding the 8 billion stolen by UMNO cronies in the process. No let up. If you don't speak, no one will speak for Sabah. If no one leads the way, no one will stepp out, but your people will lose their future and history will judge you harshly. A decision like the one you made needs tenacity and patience and there should no be retreat because Sabah's supreme interest is at stake. They want to bribe your deputy and let him insult you and the rest of SAPP leades, they should know that by sacrificing their people, they wouldn't get any respect and soon they be discarded like trash.

The ACA's action is whichhunt, criminal and a clear blackmail. Malaysia knows that and will support you. Stand firm and don't waver, falter or fail.

  6. Reading the newspaper this morning I found the word "unethical" and was surprised!

It is unethical to bring a motion of non convidence to the parlament. OK!

But tell me, what is ethical on sucking Sabah and other states high and dry, take everything away from the ppl, need passport to fly to mainland Malaysia, need workpermit to work there or a mainland Malaysian to work in Sabah, need passport to go to Labuan. I thought, Sabah and Sarawak and Labuan are part of Malaysia......was I wrong? Are this states are only part of Malaysia in Oil, Gas, and so on?

Support SAPP for a better future for you and you kids!

The only freedom that a non-Malay and non-bumi has is to migrate out of Malaysia. But in terms of freedom to get business licenses or getting college education, no Chinese or Indian can have any kind of freedom. And now that YTL has criticized UMNO, he is being investigated by the ACA in a blatant attempt at intimidation. Anyone who think there is freedom in Malaysia is either braindead or a UMNO saboteur. But go ahead and intimidate Mr. Yong. The more you intimidate him the more the Sabahan will stand by him and support him. In the end, you will only give him the most precious currency a politician can have which is credibility. And even if you arrest him, he will get out of jail and have all Sabah rally behind him like the people in Malaya rallied behind Anwar.

As to this talk about LKY sueing anybody, you have to provide more data and not just make up slanders. Many defamation had been put in various papers and magazines. LKY sued them and won - rightfully for clear cause.

Furthermore, what is there to criticize in Singapore? All Singaporean policies are supported by the vast majority of the Singaporean people. One thing Malaysians have to know is that all eligible Singaporeans are automatically registered to vote by the government unlike Malaysian government which do its damnedest to prevent the non-Malays from voting. Furthermore, all Singaporeans are required by law to vote. Therefore, since PAP is supported by the vast majority of the Singaporeans in clean elections, it is obvious that it is the choice of the Singaporean people. Therefore, there is little to criticize in Singapore. In Singapore the economy is robust with the Singaporean per capita GDP at some $40,000 and some 6 times greater than that of Malaysia. The streets of Singapore are clean and safe. The educational system is one of the very best in the world. There is no discrimination based on race with everything based on merits. It welcomes people of all races to migrate to Singapore based on their ability and not on their race or religion. Therefore, what is there for Malaysians to demonize Singapore about?

Furthermore, there are special seats in the Singaporean government reserved for the opposition so that the voice of the opposition can be heard in the parliament.

From all this, it is obvious that Singapore has little to be criticized. And legitimate constructive criticisms are not only possible but welcomed. And least of all, Malays who keep threatening the Chinese and Indians with ACA and ISA and racist Malays who keep waving their krises have the least right to criticize Singapore and Mr. Lee who is a saint next to all the corrupt Malay political hacks that is ruining the lives of everyone in Malaysia while enriching a few UMNOputras.

In the end, the UMNO dominated Malaysian government has much to be criticized while Singaporean government and Mr. Lee have done a miraculous job to make Singapore the richest, safest, and cleanest place to live and work in the entire SE Asia. Next to Malaysia, Singapore is a heaven compared to the Malaysian hell. And even Malaysian Malays would rather go and live and work in Singapore than stay in Malaysia. And it is laughable for a little Malaysian demon squatting in his little acre of hell to jibe at the heavenly Singapore.

How many Chinese do you see in the government? In the police? In the military? In the Malay controlled banks? In Petronas? During the British colonial era, the Chinese are everywhere and were allowed to do anything. Now they cannot even own banks but must sell them to the Malays.

And anybody who think a well educated Chinese prefers to work in Malaysia for low pay and no promotion and be discriminated and treated with contempt by the arrogant Malays, then he is a fool. Well qualified Chinese all go overseas to earn much higher pays and receive more respects from civilized white peoples who can appreciate their hard work and respect their human rights and dignity. Even qualified Malays also go overseas to work to make higher pays. Only those who have no qualifications stay in Malaysia and sponge on the Chinese or the government.

And with the oil running out in 20 years or less and the Chinese continuing to leave, it is certain that in another 20 years or less Malaysia will sink down to the level of Indonesia or Papua New Guinea. Who in Malaysia can do anything but the Chinese and other non-Malays? Certainly not the Malays who have been getting free jobs at Chinese shops by virtue of NEP racist laws. And when the oil money ran out, the Malaysian government won't be able to pay for the hordes of government employees who just sit around and collect pays.

The stupid tirades of of this racist idiot reflects the real sentiment of the racist Malays. It is the reason why there is no hope for Sabah within the Malaysian federation. The Malays will only take whatever they can from Sabah and give nothing back because they are simply not smart enough to create a dynamic economy and they are too greedy to share anything with non-Malays. If the Sabahans still cannot understand this after 50 years of lies and deceit, then there is no hope for them. It is their own fault for not defending their own rights. But if they have the courage, then they can restore all their own wealth to themselves and assure themselves and their children a bright future.

The reason why the Chinese and Indians have any job at all is because they can do things that the Malays cannot do. As soon as a Malay can do a job, they kick out the Chinese and the Indians and hog it for themselves. This is why the government is filled with Malays and no Chinese nor Indians. Therefore, the reason the Chinese and the Indians have any kind of job at all in Malayis is because of their own high qualifications and in spite of the marginalization. It is certainly not because of the "efficient and dynamic" and "caring" government of the UMNO racist whose slogan is ketuanan Melayu. Frankly, if the UMNO could deny jobs to all Chinese and Indians and othe non-Malays, then they'd be the happiest.

And the reason why the Malays have jobs is because the UMNO government force the Chinese to give them jobs by racist laws. Every Chinese shop must hire at least 30% Malays. It reminds me of the Old Man of the Sea in the story about Sinbad's voyages. The Old Man of the Sea tricked Sinbad to carry him across a river on his shoulder and then refused to get off. Every time Sinbad tried to throw him off, he'd choke him until Sinbad fainted. Finally, Sinbad had to trick him into getting drunk and then threw him off and crush his head with a rock. I think there is a lesson here for the Sabahans.

If you tried to reason with the Malays, then you'd only get double talk and threats and jail. Only action will free the Sabahans.

Petronas's revenue is around RM140 billion to RM150 billion. Before tax profit is some RM50 billion. What is RM 1 billion to share between Sabah and Sarawak? It is nothing more than rounding error.

Why should Sabah and Sarawak give any oil money to the other states when Sabah and Sarawak are the poorest states in the federation? It is like a rich man robbing a poor man.

Let's all hope UMNO will expel Sabah like it did Singapore. Actually, this may be a possibility. If 30 mp's from Sabah and Sarawak join PR, then they would have 112 mp's and can take over the government. A possible response from the UMNO is to expel Sabah and Sarawak so that these mp's can be denied to PR thus allowing UMNO to remain in control of Malaya.

That would be the best thing to happen to Sabah and Sarawak since 1963. It would be equal to the great emancipation of the slaves in America following the Civil War.

Yes, that's right. When PR take over the government with the help of the Sabah mp's, then there will be plenty of time to investigate all UMNO mp's and UMNO appointed government officials, including the current head of ACA. I'm sure there is clear evidence to prosecute all these corrupt officials till doomsday.

These corrupt officials better start realizing that UMNO no longer has a lock on the government. The era has changed. The tide has turned. If these corrupt officials still tried to intimidate honest politicians, then they'd just put themselves into position to be arrested and prosecuted and jailed when the government changed. Unless they want to go down with the sinking UMNO ship, then they'd better watch what they do.

  34. This is just to remind our so-called Sabahan leaders.

The 20-point Agreement was written for the main purpose of safeguarding the interests, rights, and the autonomy of the people of Sabah upon entering the Federation of Malaysia. It was originally envisaged that Sabah will be one of the four entities in the Federation, the others being Malaya, Singapore, and Sarawak. However, as times passed, Sabah and Sarawak ended up being merely one of the 13 states in the Federation.

Many do not understand this very important fact. Sabah is not a state as such. Sabah is of the same status as Malaya. Sabah lawyers can freely practice in Kuala Lumpur but Kuala Lumpur lawyers need permission to practice in Sabah. Sabahans can freely travel to West Malaysia but West Malaysians can be denied entry into Sabah (once upon a time West Malaysians needed to show their international passport before they could enter Sabah).

Is this unfair and smacks of double standards? This was what was agreed when Sabah teamed up with Malaya, Sarawak and Singapore to form Malaysia. Whether it is fair or not is not the issue. The issue is: this was what was agreed and if it is not fair then why agree to it? You can’t agree to something, fair or unfair, just to entice a state to join the Federation and then, after it has joined, you scream about the terms being unfair and unilaterally change the terms against the wishes of the other party.

And this is what the federal government has been doing all this while. It unilaterally changes the terms of the agreement and forces the states to agree to these changes. If also forces the states to sign contracts that are one-sided and a breach of the Federation Agreement or the 20-point Agreement. But now the states are fighting back. Now the states will no longer take any shit. And this is what is happening in the Terengganu, Kedah and Sabah situations. The aggrieved parties are fighting back as they rightfully should. And Terengganu wants back its RM7 billion. Kedah is going to cut down all its trees. Sabah will go for a new government that can increase its 5% royalty to 20% (which should be 100% in the first place) plus a government that can honour the 20-point Agreement, which was the basis for it to team up with Malaya to form Malaysia.

    ReplyDelete
  35. Yes, Sabah should has its autonomy in choosing its own people to govern.
Getting directions from Federal is just a laughing stock. This is a State issue and Federal should back off.
That oil royalty issue should be open up for review. The States that have the resources should be entitled for more share, something like 20%...(not 5%). It does not need a rocket scientist to work out the fair entitlement.

  36. KL can may apply "fear tactics upon would-be dissenting BN MPs"...but it must be remembered that it is the masses that put politicians into place.

Sabahans can no longer withstand KL's subjugation anymore! Datuk Yong, we all support you, even those many sabahan now working or residing in Malaysia.

ACA should not be juristically under the PM; it should be under the parliament.

ACA has been seen as not performing efficiently and impartially over the years, the government of the day must work very hard to ensure that ACA truly functions as it should for the benefits of the country.
    Is our ACA truly neutral?

The judiciary should be a separate branch of the government. The ACA should not be under either the PM or the parliament because it might have to investigate them. The ACA should be under the judiciary which as I said above should be an independent brach of the government with equal powers to investigate, arrest, try, and punish the PM and any MPs.

  42. Malaysia produced in 2004 a total of 617.1million barrels of equivalent (of crude oil and natural gas), of which Petronas share was 71.7 % or 442.7 mm boe. From the 442.7 mm boe, Petronas received total revenue of RM 137 billion and a pre-tax profit of RM 58 billion from US$15.3 billion.

In 2006, the production decreased to 588 mm boe. But revenue went up to RM 184 billion and net profit was RM 43 billion (probably after tax profit). The total production was 588.161 million barrels of equivalent (with 417 mm boe going to Petronas if 71% production sharing is maintained).

  45. I can't seem to find the actual oil production figures of Sabah. If anyone can find official figures, I'd appreciate it if he could provide a link. However, I've got some incidental figures about Sabah's oil and gas production. It seems that Petronas is building a new facility called the Sabah Oil and Gas Terminal (SOGT). This facility wil be able to handle 300,000 barrels per day of oil and 1 billion cubic feet per day of natural gas. So it seems that Sabah's production of oil and gas is expected to be some 300,000 bbl/d of oil and 1Bcf/d of natural gas. If this is true, then Sabah could be producing 176 million barrels of oil equivalent when SOGT is put into service. (5487 cubic feet of gas is equivalent to 1 barrel of oil. 1 Bcf of natural gas is equivalent to 182,000 barrels of oil.)

At US$100 per barrel, 176 million barrels is worth US$17.6 billion or RM 57 billion. Presuming 70% production sharing, Sabah will get RM 40 billion. After deducting expenses of 60%, it will leave some RM 16 billion. Dividing this by 2.5 million Sabahans. It will give each Sabahan RM 40,000 per year.

But this is if Sabah is independent and can keep all its oil profits. If Sabah remained in Malaysia, then it will probably get less than RM 1 billion per year. Divide RM 1 billion by 2.5 million Sabahans, each will get RM 400. But no Sabahans will get even RM 400. All the money will probably just disappear into this project or that project and ended up who knows where.

So do you want RM 40,000 per year or do you want RM 0 per year? Your choice.

For figures I provided above, please go to the following link:

Dividing RM 16 billion by 2.5 milion Sabahans will actually give each Sabahan RM 6,400 only. Sorry about the error. But RM 6,400 is still 16 times more than RM 400 and infitely more than RM 0.

    ------------------------------

Actually, this particular malaysian is wrong. Things have already changed and BN had been opposed or "againsted" successfully at the last election. The monster BN had been wounded if not slayed by the Malaysian people. Or he is too stupid to understand that PR has captured 5 states out of 11 in Malaya. And if you count KL FT as a state, then PR has captured 6 states out of 12 which means half of the political units in Malaya is already gone out of BN's control. And now BN is in total disarray as UMNO is falling apart and MCA and MIC is all but defunct. And SAPP is courageously condemning BN misrule and will probably leave BN. So anybody with a brain knows that BN has already lost.

And it is only a slave who will say that it is no use to complain. Indeed just "complaining" will not accomplish anything. But if action is enacted up after complaining, then much can be accomplished and indeed had been accomplished and is continuing to be accomplished. The end of this is not over yet.

I suggest this snake open his eyes and look at what has happened since the election. He is just a snake sent here by MCA or UMNO to trick the Sabahans into being like a dog and obey UMNO-BN forever. But I think the Sabahans are smarter than that. I think they can learn a lesson after 45 years of lies and deceit.

If Sabahans now stop demanding their fair share of the oil money and other rights, then they would have lost their golden opportunity and "snatch defeat from the jaws of victory." If the Sabahans stand up like a man and demand what is rightfully theirs, then the BN will collapse and disappear. BN has already been mortally wounded by PR. Sabah must administer the coup de grace and be rid of this monster once and for all.

In fact, I would suggest that SAPP and other parties organize protest marches immediately to support Sabahans' demand for greater share of oil money and other rights which have been abused and robbed by the UMNO-BN. Would you march if by marching you can get tens of thousands of rinnits per year for 20 years or more? I think smart people would.

    As Shakespeare wrote:

" There is a tide in the affairs of men. Which taken at the flood, leads on to fortune; Omitted, all the voyage of their life Is bound in shallows and in miseries "

Democracy allows the people to be the master. Now is the time for the Sabahans to become the master of Sabah and Sabahan resources. If they are not courageous enough to demand what is rightfully theirs, then they cannot blame BN for robbing them.

  60. Both SAPP MPs not in Dewan Rakyat today
    Posted by St Low
    Monday, 23 June 2008
The members of Parliament from the Sabah Progressive Party members of Parliament are not in the Dewan Rakyat today.

The party's Sepanggar member Datuk Eric Enchin Majimbun, when contacted at 11.35am today, said he would not going to the Dewan Rakyat.

"I have a meeting with Datuk Yong and after that I have to attend a relative's funeral. I will not be coming today," he said when contacted by phone.

Eric said he did not know if Datuk Chua Soon Bui (Tawau) would attend the meeting later in the afternoon. Chua could not be reached by phone.

Both MPs’ presence in the House was highly anticipated as they were expected to vote against the government today.

SAPP leader Datuk Yong Teck Lee had vowed to move a motion of no confidence against the government last Wednesday and the party's supreme Council had endorsed it.

However, talk in parliament this morning centred around both when Chua and Eric were not spotted in the Dewan Rakyat.

During the 90-minute question time, their absence was felt as their seats remained vacant.

Though both could not table any motions today, they could have registered their party's displeasure by voting against the Domestic Trade and Consumer Affairs Minister, Datuk Shahrir Samad's motion on inflation.

Shahrir is currently tabling the motion.

    The debate will start shortly.

The PR has the support of the majority of Malaya people, both Malays and non-Malays. MCA, MIC, and Gerakan have all broken apart and all but ceased to exist. And UMNO is breaking apart also with Badawi on the way out and Mahathir telling UMNO mp’s to leave UMNO. Therefore, BN is no longer the majority in Malaya. It is only in Sabah and Sarawak where the mp's are still afraid of the BN. The Sabahans on the other hand have spoken out clearly that they no longer support BN. Did you not see the poll at this blog? In case you didn’t see the poll results, here are the result:

    Question:
    Should SAPP
    1. Stay with BN: 3%
    2. Leave BN & Non-align: 10%
    3. Leave BN & Join PR: 85%

    Question:
Is the vote of no confidence relevant:
    1. Yes: 86%
    2. No: 13%

Obviously, the vast majority of the Sabahans are against BN and support the SAPP in trying to ask for more oil money and to improve the conditions of the Sabahans.

Did you not read the outpouring of Sabahan after Sabahan who are against BN? Just count how many people have spoken out at this forum against BN. If you can count beyond 2 you will see that hundreds have spoken out to support Datu Yong and SAPP. And for every one who has spoken out to support Datu Yong and SAPP, you can be sure that thousands more are in agreement. And no more than a few have spoken out in support of the BN. You can count them on the fingers of your hand.

It is clear that the people of Sabah are in support of Datu Yong and SAPP. And it is also clear that UMNO-BN will fall in September and a new government will form under the PR. Anybody who is still supporting BN will find themselves on the outside. If that is where you want to be, then fine. Otherwise, you’d better look carefully where you’re going.

As for the Sabahans, they’re all supporting Datu Yong and SAPP and will get to share much more oil money and see government policies change for the better.
